Animal Licensing Terms & Conditions
These Animal Licensing Terms (“Terms”) govern participation in PawSource’s animal licensing program and the commercial use of animal likenesses, photographs, videos, and related content created, captured, licensed, or distributed by PawSource (“PawSource,” “we,” “our,” or “us”).
By participating in the PawSource licensing program, submitting an animal for consideration, signing a release, or accepting compensation related to an animal licensing opportunity, the animal owner or authorized representative (“Owner”) agrees to these Terms.
Program Overview
PawSource connects pet owners, animal handlers, rescues, businesses, agencies, and brands with authentic animal content for commercial, advertising, marketing, editorial, promotional, and creative purposes.
Participation does not guarantee selection, compensation, project opportunities, or future engagements.
Ownership Verification
Owners represent and warrant that:

They are the legal owner or authorized caretaker of the animal.

They have the authority to grant permissions outlined in these Terms.

Information provided during registration is accurate and complete.
-
No third party possesses rights that would prevent participation.
PawSource may request proof of ownership at any time.
Grant of Rights
By participating in a PawSource project and executing the applicable release forms, the Owner grants PawSource and its clients the right to capture, record, photograph, film, reproduce, edit, publish, display, distribute, license, and otherwise use the animal’s likeness.
Such use may include:

Advertising campaigns

Social media content
-
Websites
-
Television
-
Streaming platforms
-
Digital marketing
-
Print advertising
-
Trade shows
-
Presentations
-
Editorial publications
-
Public relations materials
-
Promotional materials
-
Educational materials
The granted rights may be worldwide and may continue for the duration specified within the applicable project agreement or licensing agreement.
Content Ownership
Unless otherwise agreed in writing:

PawSource owns all photographs, videos, recordings, edits, derivative works, and creative assets created during a PawSource project.

Participation does not transfer ownership rights to the Owner.

Owners may not commercially license project content to third parties without written authorization from PawSource.
Any usage rights granted to Owners will be specified separately in writing.
Compensation
Compensation varies by project and may include:

Flat participation fees
-
Licensing royalties
-
One-time buyouts
-
Gift cards
-
Product exchanges
-
Promotional opportunities
Compensation terms will be outlined in the applicable agreement.
Unless otherwise specified:

Compensation is paid only for approved participation.

Selection for a project does not guarantee future opportunities.
-
PawSource reserves the right to structure compensation differently across projects.
Animal Health and Safety
Owners agree that participating animals:

Are reasonably healthy and suitable for participation.
-
Are current on required vaccinations where applicable.
-
Do not present undisclosed safety concerns.
-
Have no known aggressive behavior that could create unreasonable risk.
Owners must disclose:

Bite history
-
Aggression concerns
-
Medical conditions
-
Behavioral limitations
-
Mobility concerns
-
Anxiety triggers
Failure to disclose material information may result in immediate removal from the program.
Owner Responsibilities
Owners remain responsible for:

Transportation to and from project locations unless otherwise agreed.
-
Animal handling and supervision.
-
Leashes, harnesses, carriers, and required equipment.
-
Compliance with local laws and venue requirements.
PawSource may provide direction during production but does not assume ownership, custody, or permanent responsibility for any animal.
Project Selection
PawSource and its clients reserve sole discretion regarding:

Animal selection
-
Casting decisions
-
Content usage
-
Campaign participation
-
Licensing opportunities
Submission of an animal does not guarantee selection.
No Guarantee of Exposure or Future Work
Participation in the licensing program does not guarantee:

Advertising exposure
-
Social media exposure
-
Future bookings
-
Ongoing licensing opportunities
-
Revenue generation
-
Compensation beyond agreed project terms
Limitation of Liability
To the fullest extent permitted by law, PawSource shall not be liable for:

Travel expenses
-
Lost opportunities
-
Missed bookings
-
Indirect damages
-
Consequential damages
-
Loss of income
-
Emotional distress arising from project participation
Participation is voluntary and undertaken at the Owner’s own risk.
Indemnification
Owners agree to defend, indemnify, and hold harmless PawSource, its employees, contractors, affiliates, partners, and clients from claims arising from:

Ownership disputes
-
Undisclosed behavioral issues
-
Injury caused by the animal
-
Violation of these Terms
-
False representations made by the Owner
Removal from Program
PawSource may remove an animal or Owner from the licensing program at any time, including but not limited to:

Safety concerns
-
Behavioral concerns
-
Fraudulent information
-
Violation of agreements
-
Professional conduct concerns
Removal does not affect rights already granted under executed agreements.
Governing Law
These Terms shall be governed by the laws of the State of New Jersey.
Any disputes arising under these Terms shall be resolved in the courts located within New Jersey.
